If you are under 18 years old, you must have the consent of a parent or legal guardian to use the Website. ComfiAire reserves the right to request proof of age at any time and may suspend or terminate your access if you do not meet the age requirements.

These Terms between you ("you", "your", “purchaser/owner”, "user", or any applicable variation) and ComfiAire, along with its subsidiaries, affiliates, employees, agents, successors, and/or assigns ("ComfiAire", "we", "us", or "our"), (individually the “party” and collectively the “parties” to these Terms), constitute a legally binding agreement. These Terms, along with any documents expressly referenced and other policies posted by ComfiAire on the Website, govern your access to and use of our Website, ComfiAire.com and any ComfiAire Services. By accessing or using ComfiAire.com or any ComfiAire Services, you confirm, on behalf of yourself, your household members, and anyone using ComfiAire Services through your account, that you have read, understood, and agreed to these Terms, along with any applicable laws and regulations. If you do not agree to these Terms or are unable to comply with them, you must immediately cease using our Website and ComfiAire Services.

When you use a ComfiAire Service (such as Your Account, gift cards, videos, media library, or applications), you will also be bound by the guidelines, terms, and agreements specific to that Service ("Service Terms"). In the event of any conflict between these Terms and the Service Terms, these Terms will take precedence.

ComfiAire reserves the right, but not the obligation, to monitor the content and usage of this Website to ensure compliance with these Terms and any legislations and regulations. ComfiAire may refuse or restrict your access to the Website and have the right to edit, decline to post, or remove any material submitted or posted. This includes content deemed to have violated the Terms of this Website, at ComfiAire’s sole discretion.

Your access to the Website may occasionally be interrupted due to various factors, such as equipment malfunctions, scheduled updates, or maintenance. ComfiAire reserves the right to modify, suspend, or discontinue your access to the Website, or any portion of it, at any time, for any reason, at our sole discretion, and without prior notice. We will not be held liable for any unavailability of the Website, whether in part or in full, for any duration or at any time. 

Certain websites may have additional terms and conditions governing their use or may require you to enter into a written agreement with us, such as an End User Licence 
Agreement. Any terms outlined in a separate written agreement or additional posted terms specific to a website will be incorporated into these Terms and become part of your agreement with us. In the event of a conflict, the provisions of the written agreement will take precedence, followed by the additional posted terms, and finally, these Terms. 

REVISIONS TO TERMS

ComfiAire reserves the right to modify these Terms at its sole discretion at any time. It is your responsibility to review any updates, changes, modifications, or additions and your continued use of ComfiAire Services after modifications are posted constitutes your acceptance of the revised Terms. Such changes will take effect immediately, which may be provided through various means, including posting on the Website, web application updates, push notifications, or emails.

These Terms will remain in effect as long as you access or use the Website and any ComfiAire Services, or until terminated in accordance with these Terms. We may, at any time: (i) suspend, withdraw, discontinue, modify, or terminate the website entirely, or (ii) suspend, withdraw, discontinue, modify, or terminate these Terms and your rights to access or use the website, particularly if we determine that you have restricted or inhibited another user’s access or have otherwise violated these Terms. 

Upon termination of these Terms, your authorization to use the website will automatically end, and you must immediately destroy any materials you have downloaded or printed.

ELECTRONIC COMMUNICATIONS 

When you use ComfiAire Services or send emails, text messages, and other
communications from your desktop or mobile device to us, you are communicating with
us electronically. You consent to receiving electronic communications from us, including emails, texts, mobile push notifications, or messages on this site and through other ComfiAire Services. You may retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications we send to you electronically fulfill any legal requirement for such communications to be in writing.

INTERACTIONS WITH COMFIAIRE 

At ComfiAire, we prioritize providing our employees with a safe and respectful working environment; and we expect our customers to treat all ComfiAire employees with dignity and respect. Engaging in obscene, threatening, defamatory, or otherwise harmful language during interactions with our employees is a violation of our Terms. If we determine that you have subjected our employees to inappropriate language or behavior, we will take appropriate measures to address the situation, including, but not limited to, blocking your ability to communicate with ComfiAire or closing your account.

ACCOUNT REGISTRATION 

Registration for an account on the Website is not mandatory to access or use the Website, however, to use certain ComfiAire Services, you may need to create a ComfiAire account and be logged in, with a valid payment method associated with your account. An account will be created for you as a Registered User, and you will receive a username and password for accessing your account. You are fully responsible for keeping your account and password confidential, restricting access to your account, and accepting responsibility for all activities that occur under your account or password. You must ensure that all individuals who access or use the Website through your Account are informed of and comply with these Terms. You are also responsible for canceling your Account, which you may do at any time in accordance with these Terms. You agree not to disclose, sell, assign, or transfer, or offer to sell, assign, or transfer your username, password, or account to any third party or permit any third party to use your credentials without prior written consent from us. ComfiAire reserves the right to suspend or terminate your account at any time, including but not limited to instances where you breach any Terms, provide inaccurate or incomplete information during registration, or engage in activities that could result in financial loss or legal liabilities for you, other Registered Users, or ComfiAire. ComfiAire is not responsible for any damages arising from your failure to protect your account information. ComfiAire reserves the right to deny the creation of an account, refuse registration, service, terminate accounts, revoke your rights to use ComfiAire Services, remove or edit content, or cancel orders at its sole discretion. You agree not to register for the Website if you are a competitor of ComfiAire or intend to monitor the Website’s functionality or engage in any other competitive activity. You agree to immediately notify ComfiAire of any unauthorized access or use of your username, password, or Account, or any other security breach.

If there is an issue with charging your selected payment method, we may charge any
other valid payment method linked to your account. You can manage your payment
options by visiting Your Account.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

You may post reviews, comments, photos, videos, and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, provided the content is not illegal, obscene, threatening, defamatory,  invasive of privacy, infringing on intellectual property rights (including publicity rights), or otherwise harmful to third parties or objectionable. You agree not to submit any false, misrepresented, or misleading information to the Website. Additionally, the content must not contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of spam or unsolicited commercial electronic messages. You agree not to use the Website or its content to harass, harm, abuse, insult, defame, intimidate, or discriminate against others based on gender, sexual orientation, race, ethnicity, age, national origin, or disability. You may not use a false email address, impersonate any person or entity, or otherwise mislead others about the origin of the content. ComfiAire reserves the right (but not the obligation) to remove or edit such content, though it does not regularly review posted content.

By posting content or submitting material, unless otherwise indicated, you grant ComfiAire a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content worldwide in any media. You also grant ComfiAire and its sublicensees the right to use the name you submit in connection with the content, if they choose. You represent and warrant that you own or control all rights to the content you post, that the content is accurate, that its use does not violate this policy or cause harm to any person or entity, and that you will indemnify ComfiAire for any claims arising from the content you provide. ComfiAire has the right, but not the obligation, to monitor, edit, or remove any activity or content. ComfiAire assumes no responsibility or liability for any content posted by you or any third party.

ACCESS AND LICENCE

Subject to your compliance with these Terms and any applicable Service Terms, and the payment of any applicable fees, ComfiAire or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the ComfiAire Services for personal and non-commercial purposes. This licence does not permit the resale or commercial use of any ComfiAire Services or its content; the collection or use of product listings, descriptions, or pricing; derivative use of any ComfiAire Services or its content; downloading, copying, or using account information for third-party benefit; or the use of data mining, robots, or similar data-gathering tools. You may not use any output from the ComfiAire Services to develop machine learning models or related technology.

Your access to or use of the Website does not grant you any ownership rights in the
content, code, data, or other materials found on the Website.

ComfiAire explicitly reserves all rights not expressly granted to you under these Terms.
We retain the right to take appropriate legal action, including but not limited to referral to law enforcement, for any unlawful or unauthorized use of the Website.

All rights not expressly granted to you in these Terms or any Service Terms are reserved by ComfiAire or its licensors, suppliers, publishers, rights holders, or other content providers. No part of any ComfiAire Services may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for commercial purposes without the express written consent of ComfiAire. You may not frame or use framing techniques to enclose any ComfiAire trademarks, logos, or other proprietary information (including images, text, page layout, or forms) without ComfiAire’s written consent. The use of any meta tags or hidden text utilizing ComfiAire's name or trademarks is also prohibited without express written consent. You may not misuse the ComfiAire Services and may only use them as permitted by law. The licences granted by ComfiAire will terminate if you fail to comply with these Terms or any Service Terms.

You agree not to:
  • Use another user’s account without their explicit permission, nor solicit, collect, or use the login credentials of other users.
  • Sell, transfer, license, or assign your account, username, or any associated account rights.
  • Circumvent, disable, or interfere with any security-related features of the website or features designed to prevent unauthorized use or copying of materials.
  • Engage in activities that disrupt or interfere with the website, including transmitting malicious code such as viruses, spyware, or malware.
  • Inject content or code that alters the display or functionality of the website in a user’s browser or device.
  • Modify or alter any part of the website without permission.
  • Use automated systems (e.g., robots, spiders, offline readers) that send excessive request messages to our servers beyond what a human can reasonably produce using a standard web browser.
  • Scrape, embed, frame, or hotlink any part of the website, including documents, text, images, or code.

CONTENT OWNERSHIP AND LICENCE GRANT BY YOU

You acknowledge that you will not receive compensation for ComfiAire’s use of your
content. You grant ComfiAire a non-exclusive, royalty-free, perpetual, revocable, and fully sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your content worldwide in any media. This licence also includes the right to use the name and social media profile associated with your content. "Content" refers to any photographs, text, graphics, videos, audio, illustrations, or other materials, including metadata or location information, provided by you or accessed through your social media platforms.

You represent and warrant that you own or have rights to the content you provide, that the content is accurate, and that its use will not harm any person or entity. You agree to indemnify ComfiAire against any claims arising from the content you provide. ComfiAire assumes no responsibility or liability for your content.

If you wish for ComfiAire to stop using your content, please provide a detailed description of the issue to ComfiAire Customer Care at support@comfiaire.com with the subject line:“Infringement of Rights” and we will remove the content within 30 business days.

TRADEMARKS

Graphics, logos, page headers, button icons, scripts, and service names available
through any ComfiAire Service are trademarks or trade dress of ComfiAire or its affiliates, in Canada and other countries. These may not be used in connection with any product or service not offered by ComfiAire or its affiliates, in any manner likely to cause confusion among customers, or in any way that disparages or discredits ComfiAire or its affiliates. All other trademarks not owned by ComfiAire or its affiliates that appear in any ComfiAire Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by ComfiAire or its affiliates.


COPYRIGHT

All content, and the compilation of all content, provided through any ComfiAire Services, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of ComfiAire or its content providers and is protected by Canadian and international copyright laws.

RISK OF LOSS

All purchases of physical items from ComfiAire are governed by a shipment contract. This means that the risk of loss and title for the items pass to you when we deliver them to the Shipping Carrier, or if the items are crossing an international border, when they clear customs in Canada.

EXCHANGES, RETURNS, REFUNDS, AND TITLE

ComfiAire does not take title to returned items until they arrive at our warehouse. Please refer to our Exchanges, Returns and Refund sections for more details.

PRODUCT DESCRIPTIONS 

ComfiAire strives to provide accurate information, however, we do not guarantee that
product descriptions or other content on any ComfiAire Services are accurate, complete, reliable, current, or error-free. If a product offered by ComfiAire does not match its description, your only remedy is to return it in brand new and unused condition, unless applicable laws in your province of residence provide you with other rights or remedies. Product descriptions are subject to change at any time without notice.

PRICING

"List Price" refers to the suggested retail price of a product. We may not be able to confirm the price of an item until you place an order. Despite our best efforts, a small number of items on the Website may be mispriced. If the correct price of an item sold by ComfiAire is higher than the stated price, at our discretion, we may contact you before shipping, or cancel your order and notify you of the cancellation. Product pricing is subject to change at any time without notice.

COUPON POLICY

ComfiAire regularly shares coupon codes with our newsletter subscribers and are delighted to see more customers joining our mailing list. You can subscribe to our emails to receive the latest coupons and sales notifications promptly.

ComfiAire reserves the right to modify, refuse, or terminate any coupon or promotion at its sole discretion and without prior notice.

By redeeming our coupons, you agree to our terms and guidelines:
  • Usage Restriction ComfiAire coupons are valid only for purchases made on www.ComfiAire.com.
  • Eligibility Conditions Discounts typically require meeting conditions such as minimum order value, selected items, or quantity thresholds. Sales taxes are ComfiAire calculated based on the amount paid and not considered part of the order value for coupons with minimum spend requirements.
  • Expiration Expired coupons are not accepted. Coupons expire at 11:59:59 PM Eastern Standard Time (EST) on their stated expiration date.
  • Non-Monetary Value Coupon codes have no cash value. If you initiate a return, only the amount paid will be refunded.
  • Verification Before Purchase Ensure the discount is applied before placing your order. By completing your order, you agree to the final price and cannot request reimbursement for a missed coupon or discount after payment.

ComfiAire reserves the right to restrict access to or sales of products or services through the Website to certain individuals, geographic regions, or jurisdictions.

Third parties, other than ComfiAire, may provide services or software, and sell product

If you access or purchase products or services from these businesses or individuals, you are accessing or buying directly from them, not from ComfiAire. We do not examine or evaluate, nor do we warrant the offerings of, these businesses or individuals (including the content on their websites). ComfiAire assumes no responsibility or liability for the actions, products, or content of these or any other third parties. CHILDREN ACCESSING COMFIAIRE SERVICES

ComfiAire does not sell products intended for direct purchase by children under the age of majority. If you are under the age of majority in your province or territory of residence, you may use ComfiAire Services only with the involvement of a parent or guardian.

ADDITIONAL COMFIAIRE SOFTWARE TERMS

The following terms ("Software Terms") apply to any software, including updates or
upgrades, and related documentation provided to you in connection with ComfiAire
Services (the "ComfiAire Software"):


Use of the ComfiAire Software

You are permitted to use the ComfiAire Software solely to access and use the ComfiAire
Services as provided by ComfiAire, in accordance with these Terms and any Service
Terms. You may not integrate any part of the ComfiAire Software into other programs,
combine it with other software, copy it, modify it, create derivative works, distribute, assign any rights to, or license the ComfiAire Software, either in whole or in part, except as necessary to exercise rights granted in these Terms or with the prior written consent of ComfiAire. All software used within ComfiAire Services remains the property of ComfiAire or its software providers and is protected by Canadian and international copyright laws.

Use of Third-Party Services

When using ComfiAire Software, you may also be using third-party services, such as a
wireless carrier or mobile software provider. Your use of these services may be subject to separate policies, terms of use, and fees imposed by these third parties.

No Reverse Engineering

You are prohibited from reverse engineering, decompiling, disassembling, tampering with, or bypassing any security measures associated with the ComfiAire Software, either in whole or in part.

Updates

We may provide automatic or manual updates to the ComfiAire Software at any time,
without prior notice.

Conflicts

In the event of a conflict between these Terms and any other ComfiAire or third-party
terms related to ComfiAire Software, such as open-source licence terms, the third-party terms will take precedence over these Terms for that specific portion of the ComfiAire Software and to the extent of the conflict. 

PROCEDURE FOR NOTICE AND CLAIMS OF INFRINGEMENT OF RIGHTS

If you believe your intellectual property rights or copyright have been violated, please submit your complaint to ComfiAire Customer Care immediately and within 24 hours of discovery at support@comfiaire.com with the subject line: “Infringement of Rights”. We will respond promptly to concerns from rights holders regarding alleged infringements and take appropriate action within 30 business days, including terminating repeat infringers when necessary.

Written claims of infringement of rights must include the following details:
  • A physical or electronic signature of the person authorized to act on behalf of the rights holder.
  • A description of the work that you believe has been infringed.
  • A description of the location of the allegedly infringing material on the site.
  • Your name, address, telephone number, and email address.
  • A statement asserting that you have a good-faith belief that the disputed use is not authorized by the rights holder, their agent, or the law.
  • A statement confirming that the information in your notice is accurate and that you are the rights holder or authorized person to act on behalf of the rights holder.

TERMINATION

Any obligations or liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms for all purposes. These Terms remain in effect until terminated by either you or ComfiAire. You may terminate these Terms at any time by notifying ComfiAire that you no longer wish to access or use the Website or by discontinuing your use of the Website.

Any breach or violation of these Terms may result in the termination of your access to or use of the Website. If we determine, at our sole discretion, that you have failed to comply with any provision of these Terms or suspect such failure, we may terminate your access or use without prior notice. In the event of termination, you will remain responsible for all amounts owed up to and including the date of termination.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

You expressly agree that use of this website is at your sole risk. ComfiAire makes no representations or warranties, either express or implied. ComfiAire Services are offered on an "as is" and "as available" basis and ComfiAire does not guarantee the accuracy, timeliness, accuracy, sequence, completeness, or reliability of the ComfiAire Services, along with all information, content, materials, products, software, and other services provided through the ComfiAire Services, its servers, or electronic communications sent from ComfiAire will operate without interruption or errors, viruses or other harmful components.

To the fullest extent permitted by law, ComfiAire disclaims all warranties and conditions, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose; and ComfiAire will not be liable for damages or injuries of any kind arising from the use or inability to use any ComfiAire Services or from any information, content, materials, products, software, or other services provided through the ComfiAire Services, including, but not limited to direct, indirect, special, incidental, consequential, or punitive damages, unless otherwise specified in writing. ComfiAire is not liable for errors, inaccuracies, omissions, or other defects in the
information provided on this website, nor for delays, interruptions, or the untimeliness or inauthenticity of the information. Furthermore, ComfiAire is not responsible for any thirdparty claims or losses, including lost profits or punitive damages; and disclaims liability for business or investment decisions based on website information and recommend seeking expert advice before making such decisions. This includes damages and injuries caused by breach of contract, negligence, or any other cause of action. You expressly acknowledge that ComfiAire is not responsible for defamatory, offensive, or illegal conduct by other users or third parties, and you assume full responsibility for any resulting harm.

The laws of certain jurisdictions may not allow limitations on implied warranties or conditions, or the exclusion or limitation of certain types of damages. If these laws apply to you, you may have additional rights as some or all of the disclaimers, exclusions, or limitations may not apply; and ComfiAire's liability is limited to the maximum extent allowed by applicable law.

LIMITATION OF CLAIMS 

You agree that any claim, action, or proceeding arising out of or related to ComfiAire, ComfiAire Services, the Website, these Terms must be commenced within one (1) year from the date the cause of action arose, regardless of when you become aware of the claim. This limitation applies to all claims, whether in contract, tort (including negligence or strict liability), or otherwise.

To the fullest extent permitted by law, this limitation period overrides any statutory limitation period that would otherwise apply.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ComfiAire, along with its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from and against any claims, demands, liabilities, or expenses, including reasonable legal and attorney’s fees, arising from or related to your access to or use of the Website or ComfiAire Services, your violation of these Terms, your failure to provide accurate, complete, and current information when using the Website or ComfiAire Services, your misuse of the Website or ComfiAire Services, your user-generated content, or your violation of any laws or the rights of a third party. You acknowledge that a breach of these Terms by you could result in irreparable harm to ComfiAire, for which monetary damages would not provide an adequate remedy. In the event of an actual or threatened breach, ComfiAire reserves the right to pursue an injunction to prevent or address the breach without the requirement to prove actual damages or post an injunction bond. Additionally, ComfiAire may seek a decree for the specific enforcement of these Terms, along with any other remedies available. 

GOVERNING LAW AND DISPUTE RESOLUTION

By using any ComfiAire Services, all parties agree that the laws of the Province of Ontario, and the applicable laws of Canada therein, without regard to conflict of laws principles, will govern these Terms and any disputes that may arise, unless otherwise specified. The parties irrevocably agree that any dispute, controversy, or claim arising out of or relating to the terms, including any questions regarding its application, interpretation, implementation, or validity, shall be subject to the jurisdiction of the Province of Ontario, and further agree to submit to the jurisdiction of those courts in the Province of Ontario. The parties agree to meet to pursue resolution through negotiation or other appropriate dispute resolution process in Markham, Ontario, Canada. If the dispute is not resolved within a reasonable time, then any and all outstanding issues may be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not
successful in resolving the entire dispute within a reasonable time or is navailable, any outstanding issues will be submitted to final and binding arbitration before a single arbitrator, who will have full authority to neutrally mediate and arbitrate the dispute, in accordance with the laws of the Province of Ontario. The arbitrator's award will be final, and judgment may be entered upon it by any court having jurisdiction within the Province of Ontario. This does not prevent any party from seeking injunctive relief if failure to do so could result in significant harm. Each party will be responsible for their own costs of legal, attorneys, experts or other fees unless prohibited by law. All parties expressly waive the right to act as a class representative or class member, the right to participate in a class action, or the right to consolidate individual actions.

GOVERNING LANGUAGE

The parties expressly wish for these Terms to be written in English. In the case of any inconsistency, discrepancy, or conflict between the English version of these Terms and a translated version in another language, the English version will take precedence.

GENERAL PROVISIONS

We reserve the right to modify our Website, policies, Service Terms, and these Terms at any time. If any provision is found to be invalid, void, or unenforceable, that provision will be considered severable and will not affect the validity or enforceability of the remaining provisions. Furthermore, any waiver by ComfiAire of a specific provision shall not be considered a continued or additional waiver of that provision or a waiver of any other provision. Notwithstanding any statute or law to the contrary, any claim or cause of action arising from or related to these Terms must be initiated within one year from the date the claim or cause of action arose; or it will be permanently barred.

ENTIRE AGREEMENT

These Terms represent the entire understanding between you and ComfiAire and govern your access to and use of the Website and ComfiAire Services. These Terms supersede any prior or agreements or any other communications, oral or written, between you and ComfiAire. ComfiAire may update these Terms at its sole discretion by posting revised terms on this site or its successor and changes take effect upon posting.
